You know, Jeremy, you've pretty much stated every argument that I could have made on the subject, and I couldn't agree with you more, here.

To me, it's not a question of right or wrong; it is a question of how it is being exercised in the U.S. and other countries. I don't think anyone should be given the death penalty without DNA/Video/Confession(i.e. bin Laden style)/100% conviction not just beyond all resonable doubt; and the rich should not be able to get away with it, or cost tax payers thousands if they're going to end up dead anyway (100% proof).

The question I would ask is: Should rapists, sexual offenders, and child molesters be prosecuted with the death penalty? I had to write an interview composition on this way back when, and every single woman I interviewed concluded, "Yes"
Not to mention quite a few added without my inquiring, a demand for the bastard (i.e. rapist) be tortured/castrated/raped to death by club bouncer

In my mind, it's not a question of, "Does this man deserve to die" so much as, "Does this man deserve to live?" And by committing horrendous crimes, some forfeit the privelage. Check out Sudan or the Congo. IMHO, some of these freaks do not deserve to live.
