The slope of the hypotenuses (hypotenusi?) of the two triangle partitions are not the same.
i.e Tangent theta of green triangle = 2/5 = .4
Tangent Theta of red triangle = 3/8 = 0.375
Each assembly still has the same area. The appearance of the "hole" comes from the assumption that the supposed hypotenuse is a straight line. If you look very closely it is not straight at all.
EDIT:
Here is an exaggerated view of the slope difference of the two triangle partitions in each assembly. If you look closely at the original picture, the area above the assumed straight hypotenuse of the second assembly added to the area missing under the assumed straight hypotenuse of the first assembly is exactly equal to the area of one unit on the grid (i.e the missing block in the second assembly).
