ok im starting this discussion because i think its f'ed up that parents can press charges for there kids for statutory rape. the reason im writing this is because about 2 weeks ago, I was at a nearby school kicking with some friends and a younger girl i know stopped and started talking to me. . . . . well i guess later that night she got home late and her friends told her parents that she talked to me. all of a sudden, I was being threatend for statutory rape just because her parents suspected for us to be doin the Nastay. . . . .

thaughts and opinions?

Statatory rape is a bunch of bullshit. I had a homie who got charged for with it, and actually did time in jail all over consensual sex.

I'm 17, and I see some 14 year olds that, well, don't look like 14 year olds. If I'm attracted to it, I'm gonna bone it if I can. I doubt that will change very much when I turn 18

Anyways, thats bullshit. your getting charged rape for talking to somebody on the streets? I dout they even have a case against you even if they did press charges.

Yeah it sucks that allegations like that can fly when all you did was talk to a chick. The thing is though, they are going to need evidence. All the evidence they have is that you talked to her. So don't sweat it. If you're feeling feisty, sue her family for slander.

Zoik: If that sort of thing happened to me, I'd be awful tempted to goad them into it, get my day in court, and then counter-sue for all expenses incurred. This kind of litigious shit is simple schoolyard bullying and has to be stopped.

If there's a quality law firm you can contact for a free initial consultation, do it. You don't want to be caught flat-footed if shit actually hits the fan.

If they push a rape lawsuit on you and you are found innocent, you may be able to sue them for defamation of character.

I think those parents should be sued for slander.

They are making a mockery of a very serious and emotionally destructive issue.

well, I was talking to my parents, and I guess the girls parents have been sayin shit about me so, I am actually really close to taking some legal action, as for doin her mom and sueing (sp)? that wouldnt fly,im 18. but it would be fun at the time lol.

yeah I really have nothing to wory about, but the bullshit thing in this state is that its republican, and they throw you in jail first then ask questions later lol

I find it hard to believe you have any case to sue for slander, defermation or any other damages as a result to this incident. What basis would you be suing over? What damage has happened has a result of this incidence? More importantly - who have they told that has damaged you? Has there been news paper articles claiming you are a rapist? Have girls refused to talk to you because they think you're a rapist?

Regarding your question of should parents be able to push charges of statatory - most definitely. They are responble for their children and they have legal rights over children. Obviously if they abuse those rights they get into trouble - just like if they tried to push charges of rape against you, I doubt you'd even be charged. In a more general sense, I think it would be impossible to be found guilty of rape if the underage girl denied that it happened - no matter what the parents said.

I am also very much in favour of statatory rape laws and age of consent laws. Obviously there are borderline issues - which is why in Australia (I don't know if it is the same in other countries) there are defences based on age difference and people are only usually chaged with statatory rape if the age difference is large or there are other factors involved. Remember - for somebody to be charged with statatory rape either a legal gaurdian or the child has to press charges - without a testimony from the victim it's virtually impossible to bring charges against somebody for such an offence.

Wow, if only that worked in Oregon. My girlfriend is 16 and I'm 18, but my Dad freaks out that I'm goig to be charged with rape, and so he doesn't let us be alone, or even in the same room with no supervision and the door closed. It's pretty big bullshit, becuase we're only 2 years and some even months apart. But in the state of Oregon, the age of consent is 18, if you're under it's illegal. So, by my dad's resoning, I could get charged with rape and with aiding in the dilinquency of a minor, or some retarded crap like that. It's not like we have sex anyway! Nor will we in the near future. Christ it's like he thinks I'm some sort of nympho who wants to have sex in the room next to my 7 year old sister. Yep, I'm that bad of a guy
