1. Abshire does not hold an official working title and is not legally my business partner. Out of respect to privacy issues, I am not going to publicly disclose reasons why this occurred. Commission will be appropriate and is yet to be determined.
2. Abshire does not have full awareness of all aspects of this business and will not be able to provide any accurate updates to the community without add’l info from the rest of the team. Access was limited due to legitimate reasons. Additional professionals with industry specific careers and verifiable work history/experience/background clearance are utilized for various business aspects of the project to minimize add’l errors from prior involvement with key decisions. Consultation with other various active members globally were utilized for the final design to ensure this is not a unilaterally biased product. Product design evolved with the help of many players since the prototype’s first debut at the Jan ’09 Las Vegas Jam.
3. Not sure why this was being posted since I had informed Abshire I'm unable to return phone calls from being in/out of country sometimes in rural areas but will reply to emails unless I'm in an area where internet is inaccessible. Also, there had been an unusually large amount of incoming emails (both legitimate and spam) so it may take some time to reply.
4. Release date was dependent upon target presales being reached but will try to arrange an estimated release date as soon as I receive more info. Abshire guaranteed ability to reach this prior to my commitment with funding the project. Additional funds from me will be matched equally and released based on efforts. Preorders will be given top priority.
5. I am hoping for December release date and am awaiting confirmation from manufacturers

Now that everyone knows what the current situation is makes me more at ease. My agreement with Queency has changed behind me back. In other words, I was screwed. Past attempts to communicate have gone unanswered and ignored. I have lived up to my duties, but have trouble increasing the sales numbers without a product, sales status, a current price and most importantly, a release date. I know most of you are on the fence about this shoe. Some have the problem of needing a shoe now and can't afford to prepay and buy a pair of shoes now. Without a release date, it makes it hard to sell this shoe to new customers. Trying to pull the knife out of my back, Richard Abshire

wow, this seems like a poor situation... its too bad that this is happening inside of such an awesome and potentially pivotal project. i hope it all works out, whether i fit into size 13s or not.

There is no knife to pull other than the one you have inserted for yourself. You were provided a list of required items months ago and refused to submit any personal information to investors including myself for any reference, credit check, social security, past issues with court proceedings, resume, criminal and general background verification as required by various institutions to make anything officially recognized. How can I mix my personal financials with someone unwilling to cooperate with what’s needed by my lawyers? Investors consider this as a red flag and I can’t blame anyone from walking away from this. It is a normal procedure to provide all of this to any investors, legal branches, banking, financial institution and employment agencies. I may be mistaken to assume you knew the very basic requirements of obtaining a personal or business loan, business fundamentals or when applying for a position to obtain an official title (as in resume with verifiable dates I was willing to type for you?). You are the only one to blame for lack of initiative in the completion of this requirement.

Your statement of having pre-orders secured was the primary reason why this project was funded-based on your numbers and your projections. You were reminded of this objective months ago prior to initiating the creation of any prototypes. I reminded you again of this during our last conversation last month and informed you I would not be available by phone. You were also informed there would be no additional meetings or updates from me until this was achieved. You were given the materials needed to pre-sell the shoe. But you destroyed what was ready to be the final prototype by cutting the toe box and inserting t-shirt material as you normally do with all other shoes. Whatever you think I may have told you, I never said to take scissors and cut a costly prototype to change to your personal preference. This final product was needed by photographers, was ready for testing, video taping and was intended for you to use when negotiating contracts with local vendors. Accurate testing could not be initiated when you changed the structural integrity of the shoe and it was disturbing to know you wanted to still film a commercial despite your changes hoping that cut outs would go unnoticed. Release date has been delayed until you are able to reach your presale goals.

I don’t know why you keep referencing your continued attempts to communicate with me. It is clear I am communicating with you by responding to your last posts. I re-checked my inbox and there are STILL no emails from you. Yet it appears you have been reading and responding to my posts on modified?? It makes it hard to provide a release date knowing that your primary objective has not been met. You knew this all along so please don’t act surprised. I recruited other professionals to handle other aspects and decisions for you to be able to focus on the guarantee you reassured me with prior to any funding from me. If you are unable to handle it, there is no need to complain or make excuses about this on a public forum. It is unnecessary to attack my integrity in response to any difficulties you may be having. There is no need to add dramatics to gain sympathy or support. Posting emotionally on a public forum leads me to believe you are refusing accountability for what you need to work towards. Are you mainly concerned about financial gratification? I’m not doing this for the money. I could have walked away from this project long ago and refunded people their money had I known this is how you handle responsibility. I am not relying on this as a primary or secondary source of income. In fact, went against your decision to raise the price to $120 and lowered it to try and make it affordable for the community. The money is still there for you to “workâ€

How many emails must I send to get one response. You,live somewhere in the same county that I do and yet you refuse to answer the phone. I tried three times today. What is really confusing is that one post, I am not involved and the next it is all my fault. Which is it. If you are making all the decisions, what is my place in this company. I wanted the contract signed by you before I released any private information. I have no idea who you show that info to and what they would do with it. After I went through identity theft a few years ago, I kept my personal info private. I am willing to discuss this at anytime and place. My ultimate goal is the shoe. The price I insisted on was 80.00. That is reasonable and fair for my design. What the design is today, I have no idea. If you have a mature bone in your body, call me a we can work it out.

Whatever is happening with Richard and Queency will certainly not be helped by any peanut gallery antics here on the forum guys. I have a great deal of respect for Richard Abshire and the things he has done for our community. I also have a profound appreciation for this project and what Queency is doing for all of us. I hope that the two of you will be able to come to place of understanding each other.

Also, Queency, I wanted to respond to your request for feedback by saying that for many of us, the most important and significantly appreciated aspect of this project has been your research into the ergonomics of this shoe and your focus on crafting a shoe which will effectively cushion our bodies from the specific sorts of impact inherent in footbag. My input would be to say that these aspects of the shoe strike me as the most important.

As somebody who has paid for a pair of these shoes, and is still excitedly awaiting a release date like a kid on Christmas Eve, I just wanted to say that this discussion is very concerning. It seems to me that having this discussion in public like this is actually fairly damaging to the chances of me ever getting my shoes and to sales of the shoes. It would be really, really intelligent of both parties to keep all future communications directed at each other private and to only post if they have good news that can make us excited again.

From the point of view of a buyer, finding out that there is a rift between the two main people involved in this shoe, or finding out about the faults of either from the other person is not a confidence builder. If you want these shoes to actually be released and for people to buy them, stop worrying about your reputations and start worrying about the reputation of your product!

I don't care who is right or wrong, and I don't even really care that much about whether I get my money back or not if the shoes don't come out. I was just really excited about getting a new pair of footbag shoes and I still really want that to happen. Please hide any disagreements the two of you have with each other from me and only post happy thoughts about these shoes, or definite facts. I do want to know what's going on, but only in terms of if I'll still get my shoes or not, and when.

yo rich.....since you have been shredding in a pair of these....even tho they are modded....post some pics of them and time played in them so we can see the wear and tear of them.....pics dont have to be perfect.....even a camera phone pic.

This shoe project has the feeling of a scam.

I don't think this shoe will ever be delivered, because if you were really working towards a december release date there would have been a response in a format other than *this* forum discussion. In fact, there would have been updates, and responses to inquires about the status, instead of the silence we experienced.

I *know* numerous people have asked on the facebook page about the status, only to have no response posted. Silence. Not the hallmark of a company that is addressing the concerns of their pre-paid customers, let alone a company moving towards delivering a product in the next two months.

I'm glad Rich stirred this up, because it was clear from the months of neglect that inquires about the shoe were going unanswered. Now we know, and it is what it is.

Goodwill is a lot like respect. Right now I don't have any for this project. Hopefully some shoes get made and delivered, but I see no reason to be optimistic.

Oops. I guess I was supposed to send this as a PM.
